TERMS & CONDITIONS OF SERVICE

These Terms & Conditions apply to all quotations, contracts and works undertaken by PrimeHouse Pro Services Pty Ltd ("the Company"). By accepting a quotation, instructing the Company to commence work, or allowing work to begin, the Client agrees to be bound by these Terms & Conditions.
1. Quotations

All quotations are valid for 30 days unless otherwise stated.

Quotations are based on the information available at the time of inspection.

Any changes requested after acceptance may result in additional costs.

Hidden site conditions or unforeseen circumstances that could not reasonably be identified during quoting are excluded from the original quotation.
2. Materials Payment
Payment for all materials is due upon delivery to the property and before installation commences unless otherwise agreed in writing.
Materials remain the property of PrimeHouse Pro Services Pty Ltd until paid for in full.
3. Progress Payments
Progress payments apply to all projects unless otherwise agreed in writing.
Our standard payment schedule is:

No deposit.

Payment for materials upon delivery.

Progress payments at agreed construction milestones.

Final payment immediately upon practical completion.
Failure to make a scheduled payment may result in work being suspended until payment has been received. Any delays caused by non-payment may affect the completion date and future scheduling.
4. Final Payment
The balance of the contract price is payable immediately upon practical completion of the works.
The Client may not withhold payment due to minor cosmetic items or defects that do not substantially affect the completed work. Any agreed defects will be rectified within a reasonable time.
5. Variations
Any work outside the original quotation will be treated as a variation.
Variations may include:

Additional excavation
-
Rock removal
-
Tree roots
-
Drainage works
-
Additional retaining height
-
Design changes
-
Additional paving
-
Additional materials
-
Client requested changes
Variations will be quoted and approved before additional work proceeds wherever reasonably possible.
6. Site Conditions
Quotations are based upon normal ground conditions.
Additional charges may apply where unexpected conditions are encountered, including:

Rock
-
Concrete
-
Underground obstructions
-
Poor soil
-
Tree roots
-
Underground services
-
Excessive water
-
Contaminated fill
7. Underground Services
The Client is responsible for advising the Company of any known underground services including irrigation, electrical cables, gas, water, sewer, stormwater or telecommunications.
The Company is not responsible for damage to unidentified or incorrectly located underground services.
8 Access
The Client must provide safe and reasonable access to the work area.
Delays caused by restricted access, locked gates, parked vehicles, pets or other obstructions may result in additional charges.
9. Weather Delays
Construction work may be delayed due to rain, excessive heat, strong winds or other unsafe weather conditions.
Completion dates are estimates only and may be extended where weather affects safe working conditions.
10. Ownership of Materials
Ownership of all supplied materials remains with PrimeHouse Pro Services Pty Ltd until full payment has been received.
11. Warranty
PrimeHouse Pro Services Pty Ltd warrants that all workmanship will be carried out with reasonable care and skill using quality materials.
Manufacturer warranties apply to products supplied where applicable.
This warranty does not cover:

Tree root damage
-
Storm damage
-
Flooding
-
Vehicle impact
-
Lack of drainage
-
Client misuse
-
Natural movement outside normal construction tolerances
12. Limitation of Liability
To the maximum extent permitted by law, PrimeHouse Pro Services Pty Ltd is not liable for indirect, consequential or incidental losses arising from the works.
The Company's liability is limited to rectification of defective workmanship where required under Australian Consumer Law.
Nothing in these Terms excludes any rights that cannot legally be excluded under the Australian Consumer Law.
13. Suspension of Works
The Company reserves the right to suspend work where invoices become overdue.
Any costs associated with returning to site, remobilisation or project delays caused by overdue payments may be charged to the Client.
14. Cancellation
Where works are cancelled after acceptance:

Materials already ordered must be paid for in full.

Labour and equipment already committed may be charged.

Any cancellation costs imposed by suppliers will be passed on to the Client.
15. Photography
The Company may photograph completed works before, during and after construction for quality records and marketing purposes unless the Client advises otherwise in writing before work commences.
No personal information or identifying details will be published without consent.
16. Safety
The Client agrees to keep children, visitors and pets away from active work areas during construction.
The Company may suspend work where site conditions become unsafe.
17. Governing Law
These Terms & Conditions are governed by the laws of South Australia.
Acceptance
By accepting a quotation, paying a deposit, signing a quotation, electronically accepting a quotation, or allowing work to commence, the Client confirms that they have read, understood and agree to these Terms & Conditions.
